General Terms and Conditions

1. Scope of application

These General Terms and Conditions (GTC) apply to all deliveries from ewpmi.squarespace.com (hereinafter referred to as Dr. Karl Popp) to the customer.

A customer is any natural or legal person who enters into a legal transaction for a purpose that can predominantly be attributed to their commercial or independent professional activity.

2. Contractual partner

The purchase contract is concluded with ewpmi.squarespace.com, owner: Dr. Karl Popp, Königsäcker 36, 68723 Schwetzingen, Germany.

3. Conclusion of contract

3.1. The presentation of products and services in the online shop does not constitute a legally binding offer, but only an invitation to place an order.

3.2. By clicking on the [Buy/order with obligation to pay] button, you are placing a binding order for the products and services listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation by email immediately after receiving your order.

4. Right of withdrawal

4.1. If you are a customer, you have a right of withdrawal in accordance with the statutory provisions.

4.2. If you, as a customer, exercise your right of withdrawal in accordance with clause 4.1, you shall bear the regular costs of the return shipment.

Cancellation policy

Right of cancellation

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us [enter name of the entrepreneur, address, telephone number, and email address] of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email). You can use the attached sample withdrawal form for this purpose, but this is not mandatory. If you make use of this option, we will immediately send you (e.g., by email) a confirmation of receipt of such a withdrawal.

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period expires.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us or to (insert the name and address of the person authorized by you to receive the goods, if applicable) immediately and in any case no later than fourteen days from the date on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.

You bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing their condition, properties, and functionality.

5. Prices and shipping costs

5.1. The prices stated on the product pages include statutory value added tax and other price components.

5.2. In addition to the prices stated, we charge a flat rate of 5 euros per order for delivery within Germany. The shipping costs are clearly indicated on the product pages, in the shopping cart system, and on the order page.

5.3. For cash on delivery payments, an additional fee of €5 is payable, which is collected by the delivery agent on site. No further taxes or costs are incurred.

6. Delivery

6.1. Delivery is only available within Germany.

6.2. The delivery time is up to 3 days. We indicate any deviating delivery times on the respective product page.

7. Payment

7.1. Payment is made in advance.

7.2. If you choose to pay in advance, we will provide you with our bank details in the order confirmation, offer card payment options, and deliver the products and services after receipt of payment.

8. Retention of title

The goods, documents and content remain our property until full payment has been received. All content on this website represent intellectual property and/or trade secrets of Dr. Karl Popp.

9. Warranty for material defects

Dr. Karl Popp is liable for material defects in accordance with the applicable statutory provisions, in particular §§ 434 ff of the German Civil Code.

10. Dispute resolution

The EU Commission has created an internet platform for online dispute resolution. The platform serves as a contact point for out-of-court settlement of disputes concerning contractual obligations arising from online sales contracts. Further information is available at the following link: http://ec.europa.eu/consumers/odr. We are prepared to participate in dispute resolution proceedings before a customer arbitration board for the settlement of disputes with customers or are obliged to do so in accordance with ____ (specification of the legal norm or contractual agreement). The competent customer arbitration board is: Universalschlichtungsstelle des Bundes Zentrum für Schlichtung e.V., Straßburger Straße 8, 77694 Kehl am Rhein, www.Kunde-schlichter.de. We will participate in dispute resolution proceedings before this board to settle the aforementioned disputes.

11. Description of each of the steps of shopping something in the store functionality of the webwebsite

The store shopping experience follows a structured flow that guides customers from browsing products to complete their purchase. Here's a detailed breakdown of each step:

Browse the Store

When customers visit the website, they navigate to the store page through the webwebsite's navigation menu. On the store page, they can view up to 200 products at once and filter them by category. If there are more than 200 products, customers can click "Next" to view additional items. Customers can also interact with special features like quick view or product zoom by hovering over product images.

Alternative Shopping Methods

Customers can discover products through other channels beyond the main store page. Products can be displayed on different pages of the website using product blocks or summary blocks.

View Product Details

When customers click on a product, the product details page opens. Here they can review comprehensive product information, images, and pricing. "Add to cart" buttons directly on the store page beneath product thumbnails, allow customers to add items to the cart.

Add to Cart

To add a product to their cart, customers click the "Add to cart" button. After adding an item, a cart notification appears at the top of the page showing the number of items and total cost. Customers can only purchase one subscription product at a time.

Review Shopping Cart

Customers can access their shopping cart by clicking the cart icon. In the shopping cart, they can modify quantities or remove products entirely. The cart displays all selected items with their quantities and the running total. When ready to complete their purchase, customers click the "Checkout" button. If they remove all products, a "Continue Shopping" link appears that directs to the homepage by default.

Checkout Process

The checkout page is SSL-protected to secure customer credit card data. The checkout follows these sequential steps:

Customer Account Login

If the customer has an existing customer account, they can log in to expedite the checkout process. If customer accounts are enabled on the store, new customers can create an account during checkout.

Delivery Methods

Customers choose between shipping or local pickup/delivery options. For shipping, they enter their shipping address with Google-powered autofill suggestions appearing as they type. They then select from available shipping options, which display in ascending price order with the least expensive option selected by default.

Payment and Discounts

Customers enter their payment details or select alternative payment methods including PayPal, Apple Pay, or Afterpay. If active discounts are available, customers can enter a discount code at this stage. Discounts typically apply to product costs, not shipping fees, unless it's a free shipping discount. Customers with credit cards issued in the European Economic Area may encounter an additional Strong Customer Authentication (SCA) step, such as a browser pop-up or banking app notification to verify the transaction.

Review and Purchase

Customers review their complete order and click "Purchase" to place it. If store policies have been added, they display as text links at this stage for customer reference.

Order Confirmation

After successfully completing checkout, customers land on an order confirmation page. The page content varies depending on the product type purchased. For physical, download, or service products, the page displays order status, order details, and the option to create a customer account. For subscriptions, or memberships, it shows "Order Confirmed" and the order number.

Post-Purchase Experience

Customers receive an order confirmation email immediately after completing checkout. For download products, they receive a separate email with a download link. For physical products, they receive another email when the order is fulfilled. Customers can click a link in the confirmation email to access an order status page where they can track their order, view shipping details (if logged into their account), and review billing information.
